The case dates back to a 2019 political rally in Jaipur, where Gandhi allegedly delivered derogatory comments concerning the Prime Minister. Local BJP member Mahesh Shrishrimal subsequently filed a complaint, asserting that the rhetoric not only targeted the leader of the government but also caused reputational damage to party supporters nationwide.

Following a prima facie review, the Girgaon magistrate court invoked Section 500 of the Indian Penal Code to issue summons. While the High Court had granted temporary relief by staying the hearing, that protection has now expired. Gandhi is required to appear personally before the magistrate to face the charges as the judicial process resumes.
