Padilla Proposes Seven-Year Green Card Path for Long-Term Residents

The proposed legislation, titled the Renewing Immigration Provisions of the Immigration Act of 1929, aims to replace a static 1972 eligibility cutoff with a rolling seven-year residency requirement. If passed, the change would trigger 60 days after enactment, allowing applicants without criminal records to apply for lawful permanent status. The bill specifically targets groups often trapped in legal limbo, including Dreamers, essential workers, and children of long-term visa holders.

For Indian professionals, the measure represents a potential breakthrough. Many currently endure decades-long waits for employment-based green cards due to strict country-specific caps. By amending Section 249 of the Immigration and Nationality Act, the bill grants the Secretary of Homeland Security the authority to adjust residency status based on this new timeframe. While Senator Padilla and co-leader Dick Durbin have secured 14 additional Senate co-sponsors, the path to enactment remains narrow.
