A federal courtroom in New Jersey has become the latest battleground for the two titans of the obesity drug market. Novo Nordisk is accusing Eli Lilly of running deceptive advertising campaigns that distort the efficacy of its competitors by selectively comparing newer products against older, lower-dose versions of Wegovy and Ozempic.

The lawsuit alleges that Eli Lilly violated the Lanham Act by crafting promotional material for Zepbound and Mounjaro that omits the existence of stronger, updated dosages for Novo’s flagship treatments. By framing these comparisons in a skewed light, Novo argues that its rival has gained an unfair commercial advantage. The company is now seeking a court order to force a retraction of the ads, alongside financial damages for profits allegedly captured through these misleading tactics.

This litigation intensifies the friction between the two pharmaceutical giants as they race to dominate a U.S. obesity drug sector projected to surge past $100 billion by 2030. Despite the aggressive legal maneuvering in court, investors have remained largely unmoved, with both companies' stock prices showing only minor shifts following the filing.
