US Supreme Court Upholds Birthright Citizenship in Blow to Trump Order

In a 6-3 decision, the US Supreme Court has struck down an executive order from President Donald Trump that sought to end birthright citizenship for children of parents present in the country illegally or on temporary visas, reaffirming the constitutional guarantee for anyone born on American soil.

The ruling provides significant relief to the Indian American community, which includes hundreds of thousands of professionals on H-1B, L-1, and F-1 visas. With over a million Indians currently stuck in employment-based green card backlogs, the decision secures automatic citizenship for their children, regardless of the parents' long-term immigration status. For the estimated 725,000 undocumented Indian immigrants in the US, the verdict also ensures their American-born children retain their status.

Chief Justice John Roberts, writing for the majority, emphasized that the long-standing interpretation of the Fourteenth Amendment—adopted after the Civil War—guarantees citizenship to those born in the US, with few exceptions. While Trump labeled the decision "too bad for our Country" and suggested legislative fixes, constitutional experts note that overriding the ruling would require a formal constitutional amendment. Justices Samuel Alito, Neil Gorsuch, and Clarence Thomas dissented, with Thomas arguing that the amendment’s original intent was focused on the rights of freed slaves rather than broader immigration policy.

Community leaders have lauded the outcome as a vital defense of the American Dream. Chinten Patel, executive director of Indian American Impact, noted that the ruling offers security to families who have lived in the US for years without a path to permanent residency. Congressman Raja Krishnamoorthi echoed this sentiment, stating that the decision serves as a necessary check on executive power, confirming that the Constitution, rather than the president, dictates the rights of the American people.
