Federal Judge Blocks Deportation of Students Over Political Speech

The ruling in San Jose follows a similar 2024 decision in Boston, which previously found the Trump administration’s targeting of pro-Palestinian activists unconstitutional. Judge Wise emphasized that freedoms of speech and the press are foundational, noting that immigration authorities have engaged in systemic retaliation against critics of Israeli military actions and those speaking out following the assassination of Turning Point USA co-founder Charlie Kirk last September.

By invalidating specific provisions of federal deportation policy, the court challenged the government’s attempt to weaponize residency status against political dissenters. The judge warned that allowing the state to penalize unpopular opinions risks a broader erosion of civil liberties, stating that the nation’s strength lies in protecting speech even when the content is detested. Conor Fitzpatrick, an attorney with the Foundation for Individual Rights and Expression, lauded the decision, affirming that constitutional protections must extend beyond views favored by those in power. The Justice Department has yet to issue a response to the ruling.
