The latest criminal complaint accuses Comey of compromising classified material during his tenure as the bureau’s chief. His defense attorney, Patrick Fitzgerald, noted that federal prosecutors reviewed these exact allegations during the first Trump administration and concluded they lacked merit. Comey characterized the move as an appalling abuse of the Department of Justice, maintaining his innocence via a video statement on his Substack.
This legal escalation follows a turbulent year for the former official. In September 2025, a judge dismissed charges against Comey regarding his congressional testimony, citing the unlawful appointment of the prosecuting attorney. A subsequent April indictment involving an alleged threat against the president—based on an Instagram post featuring the numbers 86 and 47—remains active. Comey denies any intent to threaten the president.
The timing of these charges aligns with a significant court victory for the Comey family. Hours before the latest documents were unsealed, District Judge Jesse Furman ruled that the July 2025 firing of Maurene Comey, the former director’s daughter, was unlawful. Judge Furman ordered the Department of Justice to reinstate her, finding that her dismissal from her post as a federal prosecutor violated her due process rights amid a broader administration-led purge of perceived political opponents.
