US District Judge Timothy Kelly, a Trump appointee, issued a 26-page ruling dismantling the administration's attempts to justify the sudden removal of hard passes. Kelly explicitly rejected the Justice Department's argument that national security concerns necessitated the move, noting a complete absence of evidence that such factors played any role in the initial decision to target specific outlets.
The court found that the president’s motivation appeared rooted in his personal disapproval of the reporting produced by the three organizations, which he frequently labeled as biased or inaccurate. By revoking credentials without notice or a meaningful opportunity for the journalists to respond, the administration failed to uphold basic due process requirements. The injunction ensures that reporters maintain their access to the White House grounds for the duration of the ongoing lawsuit, marking a significant legal setback for the administration’s efforts to restrict press coverage.
