The court’s Division Bench determined that Nagender’s decision to join the Congress and contest the 2024 Lok Sabha election from Secunderabad effectively amounted to voluntarily giving up his membership of the Bharat Rashtra Samithi (BRS). By doing so, his actions triggered the provisions of the Tenth Schedule of the Constitution. The disqualification is retroactively effective as of April 23, 2024, mandating that a fresh election be held for the Khairatabad constituency.
BJP spokesperson NV Subhash hailed the judgment as a victory for democratic integrity, accusing the Congress of engaging in backdoor politics. BRS working president KT Rama Rao suggested the ruling serves as a warning to other legislators who transitioned to the Congress after the 2023 assembly elections. While this verdict specifically targets Nagender, it intensifies the ongoing legal scrutiny surrounding several other BRS-to-Congress defectors, including Kadiyam Srihari and Pocharam Srinivas Reddy. The case underscores a persistent conflict regarding the Speaker’s role in adjudicating defection petitions within the specified timeframes.
