WTO Panel Rules Against Indonesia in EU Fatty Acid Dispute

A World Trade Organization panel sided with the European Union on Wednesday, dismissing the bulk of Indonesia’s challenge against anti-dumping duties on fatty acid imports. While the EU largely prevailed, the ruling identified a specific technical error in how the European Commission calculated dumping margins during the investigation.

The panel concluded that the European Commission committed a calculation error regarding currency conversion for specific transactions. This procedural lapse violated the WTO’s Anti-Dumping Agreement, forcing a partial correction in the EU's duty provisions. Despite this narrow finding, the panel rejected Jakarta’s broader grievances, including claims that the European Commission employed an unwritten and discriminatory methodology to determine dumping margins.

Jakarta had originally filed the complaint to dismantle trade barriers that have hampered its fatty acid exports to the European market. The final report, circulated to WTO members on Tuesday, brings a measure of clarity to the dispute, though the ruling upholds the core legal framework of the EU's protective measures.
