The Madhya Pradesh government has ignited a fierce political and legal dispute by reconstituting the state Waqf Board to include two non-Muslim experts. This move marks the first instance of such an appointment in India, unfolding while the Supreme Court continues to deliberate on the legality of non-Muslim representation in these bodies.

Congress MLA Arif Masood, also a representative of the All India Muslim Personal Law Board, branded the decision premature and unjust. He argues that the government’s swift action ignores the gravity of the ongoing judicial review. The core of the legal challenge rests on whether individuals outside the community possess the standing to influence Waqf board operations, a question that remains unresolved in the highest court.

Although the Supreme Court has not issued a formal stay, the state’s decision relies on assurances provided by the Attorney General regarding future legislative amendments. Critics maintain that the inclusion of two Hindu experts within the 10-member board constitutes a procedural overreach. As political tensions mount, stakeholders continue to contest the legitimacy of these appointments, citing the potential for conflict with pending judicial outcomes.
