Trump Administration Triggers USMCA Sunset Clause

A looming sunset clause will soon force a six-year review of the U.S.-Mexico-Canada Agreement, as the Trump administration prepares to withhold an extension. This decision casts a shadow over the future of North American trade, effectively initiating a countdown toward a potential expiration of the pact by 2036.

U.S. Trade Representative Jamieson Greer is currently maneuvering through high-stakes negotiations focused on tightening U.S. content requirements for automotive manufacturing and establishing stronger safeguards against Chinese-origin imports. While Mexico remains at the bargaining table, Canada has found itself largely sidelined from these critical discussions, deepening the regional divide.

Former USTR general counsel Greta Peisch noted that the lack of public clarity regarding specific American demands only adds to the volatility of the review process. Without a swift consensus to address these protectionist shifts, the agreement faces a period of indefinite instability. Should the parties fail to reconcile their positions during the upcoming review cycle, the foundational trade framework for the continent could dissolve entirely within the next decade.
